Amber Heard Deposition Moved by a Day as Lawyer Slams Claims She Cried and Refused to Give Testimony

Amber Heard's upcoming deposition in her ongoing legal battle with estranged husband Johnny Depp has been moved by one day.

In court documents obtained by PEOPLE, Heard, who is currently in London filming Justice League, filed a request to move her deposition from Friday to Saturday, Aug. 13, due to her inability to return stateside in time for the scheduled meeting.



"To no fault of her own, Amber was unable to arrange for a flight to travel from London to Los Angeles which would arrive in Los Angeles by 10 a.m. on Friday August 12, 2016 so that she could appear for deposition on that date and time," the filing states.


Depp, 52, is also scheduled to be deposed on Saturday, though Heard's team states that it is "highly unlikely that Johnny will appear and cooperate."

Heard was originally set to be deposed on Aug. 6, but despite appearing at Depp's lawyer's office, she never gave her testimony.

Legal docs filed by Depp's attorney Laura Wasser and obtained by PEOPLE allege that Heard refused to leave an office adjacent to the deposition room, and that despite multiple attempts throughout the day, Depp's team was unable to take her deposition.

Wasser claims she could "quite clearly" observe "Amber hysterically crying and pacing in her separate conference room, or screaming and yelling at times and laughing at others."

But in the new documents, Heard's lawyers call those claims "categorically false."

Heard's legal team maintains that the actress is ready and willing to be deposed.

"At all times, Amber has been ready to go forward with her deposition and is prepared to do so," they say in the new court filing.

In an email conversation between Depp and Heard's lawyers, it appears that the actor's lawyer agreed to the new date.

The correspondence also refers to a settlement proposal from Heard that was sent to Depp and his team for review on Aug. 11.
